This Participant Release and Waiver of Liability Agreement ("Agreement") is entered into between World Taekwondo Mandeville ("WTM", "the School", "Instructor", "Organisation"), operating at Church Teachers College Gymnasium, 40 Manchester Road, Mandeville, Jamaica, and the undersigned Parent or Legal Guardian ("Parent/Guardian") acting on behalf of the minor participant ("Participant") enrolled in the Summer Taekwondo Classes commencing July 6, 2026.
The Participant will engage in structured Taekwondo training sessions including but not limited to: warm-up exercises, stretching, basic technique drills (kicks, blocks, strikes, stances), poomsae (forms) practice, sparring drills, fitness conditioning, and related martial arts activities. Classes are conducted Monday, Wednesday and Thursday from July 6 through July 30, 2026, at Church Teachers College Gymnasium, Mandeville.
The Parent/Guardian, for themselves and on behalf of the Participant, expressly acknowledges and understands that participation in Taekwondo and martial arts activities involves inherent risks of physical injury, including but not limited to: bruising, sprains, strains, fractures, muscle injuries, joint injuries, and in rare cases, more severe injuries. The Parent/Guardian hereby voluntarily assumes all such risks associated with participation, whether foreseen or unforeseen, known or unknown, arising from the Participant's involvement in all WTM activities.
In consideration of the Participant being permitted to participate in WTM Summer Classes 2026, the Parent/Guardian, on behalf of themselves, the Participant, heirs, assigns, and next of kin, hereby releases, waives, discharges, and covenants not to sue World Taekwondo Mandeville, its instructors, coaches, staff, volunteers, officers, directors, agents, representatives, sponsors, and affiliated organisations (collectively, "Released Parties") from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, injury, or death, whether caused by the negligence of the Released Parties or otherwise, while the Participant is on the premises or participating in any activity associated with WTM Summer Classes 2026.
The Parent/Guardian agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, actions, suits, proceedings, costs, expenses, damages, and liabilities, including reasonable attorneys' fees, arising out of or connected with the Participant's participation in WTM activities, the Parent/Guardian's breach of this Agreement, or any actions or omissions by the Participant.
The Parent/Guardian hereby authorises WTM instructors and staff to seek and consent to emergency medical treatment for the Participant in the event that a medical emergency arises during participation and the Parent/Guardian cannot be reached within a reasonable time. The Parent/Guardian agrees to assume all costs associated with any such emergency medical treatment. The Parent/Guardian confirms that all medical conditions, allergies, and physical limitations disclosed in the registration form are complete and accurate.
The Parent/Guardian warrants that the Participant is in good physical health and is not suffering from any condition, illness, or disability that would make participation in Taekwondo training unsafe or inadvisable, unless explicitly disclosed in the registration form. The Parent/Guardian agrees to notify WTM promptly of any changes to the Participant's medical condition. WTM reserves the right to exclude a Participant from activities if, in the reasonable judgment of the instructor, participation would pose a risk to the Participant or others.
The Parent/Guardian agrees that the Participant will conduct themselves in a respectful, disciplined, and cooperative manner at all times while on WTM premises or participating in WTM activities. The Participant agrees to follow all instructions given by WTM instructors, respect fellow students and staff, and uphold the values and tenets of Taekwondo: Courtesy, Integrity, Perseverance, Self-Control, and Indomitable Spirit. WTM reserves the right to remove any Participant from the programme, without refund, for serious misconduct or repeated violations of the Code of Conduct.
Unless written objection is provided to WTM prior to the commencement of classes, the Parent/Guardian hereby grants WTM a perpetual, royalty-free, non-exclusive licence to photograph, film, and record the Participant during WTM activities, and to use such recordings and images for legitimate promotional and educational purposes, including but not limited to websites, social media platforms, printed materials, and broadcast media. No financial compensation will be provided for such use.
Registration fees are due upon enrolment. Fees are non-refundable unless WTM cancels the programme. Participants who withdraw after the first class are not entitled to a refund. WTM reserves the right to cancel or reschedule classes due to circumstances beyond its control (including but not limited to inclement weather, facility unavailability, or force majeure events), in which case WTM will make reasonable efforts to reschedule affected sessions or offer a pro-rata credit.
Participants aged 4–7 must be accompanied by a Parent/Guardian on the premises during all sessions. Participants aged 8 and over may attend independently; however, Parents/Guardians are responsible for ensuring prompt drop-off and pick-up. WTM assumes no responsibility for the safety of Participants outside of scheduled session times or outside the designated training area.
This Agreement shall be governed by and construed in accordance with the laws of Jamaica. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. This Agreement constitutes the entire agreement between the parties with respect to its subject matter and supersedes all prior agreements, representations, and understandings.
By completing the registration form and ticking the acknowledgement checkbox below, the Parent/Guardian declares that they have read this entire Agreement, fully understand its terms, and agree to be bound by them on behalf of themselves and the Participant. The Parent/Guardian acknowledges that this Agreement is binding and that they are signing it freely and voluntarily.
